How to read a result

  • Registered and pending marks are live: they can block a new Canadian application, so these are the rows that matter.
  • Abandoned means the application was dropped, withdrawn or refused. Cancelled means a registration was expunged or surrendered. Both are dead.
  • Classes are the 45 Nice classes of goods and services, which Canada has used since 2019. Conflict is judged within related goods and services, so the same word can belong to different owners in unrelated classes.
  • Similarity is our own measure of how close the spelling is to yours, not an official figure.

What this search covers, and what it does not

It searches the Canadian register: applications and registrations filed with the Canadian Intellectual Property Office, from CIPO's open data, refreshed every week. It does not cover Canadian marks used but never registered, provincial business names, or marks filed only in other countries. For the United States use the USPTO trademark search, and the international search for Madrid System registrations. A logo can conflict even when the words do not, so check artwork with the logo search.

Is this the official CIPO search?

No. It is our own copy of the Canadian Intellectual Property Office's open data, refreshed every week, with a faster search that also finds similar spellings. Every result links to the official CIPO record, which is the version that counts.

Is it free?

Yes. No account, no limit and nothing to buy.

Does a U.S. trademark protect my brand in Canada?

No. Trademark rights are territorial: a U.S. registration gives no rights in Canada. To be protected there you file with CIPO directly, or extend an international application under the Madrid System to Canada. An earlier Canadian mark can stop you there even if your U.S. registration is safe.

What do the statuses mean?

Registered and pending marks are live and can block a new application. Abandoned means the application was dropped or refused; cancelled means a registration was expunged or surrendered. Both are dead, though a dead mark shows the name has been wanted before.

Do I need to use my trademark in Canada before registering it?

Not since June 2019, when Canada dropped the requirement to declare use before registration. But an unused registration can be challenged after three years, so plan to use it.
