Data scope: this checks the USPTO federal register and the WIPO Madrid international register. It does not cover state trademark registrations, common-law (unregistered) marks, EU trade marks (EUIPO), or other national registers. A clean result here is a positive signal, not a guarantee of clearance. For a high-stakes filing, have a trademark attorney run a full search (when to hire one).

What this tool actually does

Most online "trademark search" tools just dump a keyword query against USPTO's database and show you a long list. That's not useful. You still have to figure out which matches matter. This tool is different. We:

  1. Use fuzzy similarity to find names that look or sound similar to yours, not just exact matches.
  2. Restrict the search to your chosen Nice classes, because likelihood-of-confusion only matters within related goods/services.
  3. Weight each match by its USPTO status: a registered (live) mark is a far bigger problem than an abandoned one from 2003.
  4. Compute a 0-100 risk score blending similarity and status weights, and bucket it into minimal / low / medium / high.
  5. Generate a brief plain-English explanation of why the risk score is what it is.

How to read the results

  • HIGH risk (75–100): a substantively similar mark is registered in your class. Filing as-is would likely face a 2(d) refusal under likelihood-of-confusion. Modify the name or pick different classes.
  • MEDIUM risk (50–74): there are concerning matches. Could go either way; it depends on the specific goods/services language and how distinct your mark is in commercial impression.
  • LOW risk (20–49): some lookalikes exist but they're either weak (abandoned, unrelated) or distant. Generally safe to file but worth reviewing the listed marks.
  • MINIMAL risk (0–19): no significant prior art. Most likely safe; still worth a quick attorney review for filings of substantial commercial value.

What it doesn't tell you

The score is about likelihood of refusal under §2(d), the most common reason applications fail. It does NOT assess:

  • Descriptiveness or genericness (§2(e)): a separate refusal ground we don't model here.
  • Common-law trademarks not registered with USPTO. State filings or pure use-in-commerce rights aren't in our dataset.
  • Trade dress, design marks, or sound marks: this is text similarity only. For a logo, run a logo similarity search to catch visually-close design marks.
  • Strategy questions (foreign filings, opposition risk, brand value, naming distinctiveness): those need a real attorney.

For high-stakes filings ($50K+ in expected brand value), use this tool as a first-pass filter, then engage a trademark attorney for clearance.
