How U.S. trademark renewal deadlines work

A federal trademark registration isn't "set and forget." To keep it alive you have to file maintenance documents with the USPTO on a fixed schedule measured from your registration date. Miss a window, even by a day past the grace period, and the registration is cancelled or expires, and you generally can't get it back. The dates below are the ones that matter.

Section 8: Declaration of Use (years 5–6)

Between the 5th and 6th anniversary of registration, you file a Section 8 Declaration confirming the mark is still in use in commerce. There's a 6-month grace period after the deadline (with an extra fee). Miss it entirely and the registration is cancelled.

Section 15: Declaration of Incontestability (optional)

Filed in the same year-5–6 window, the optional Section 15 declaration makes your registration "incontestable" after five years of continuous use, a stronger legal position against later challenges. Most owners file the combined Section 8 & 15 together.

Section 9: Renewal (years 9–10, then every 10 years)

Between the 9th and 10th anniversary, and every ten years after that, you file a Section 9 Renewal together with another Section 8 Declaration. Same 6-month grace period, same consequence for missing it. This is the deadline that keeps a registration alive indefinitely.

Some registrations follow a different schedule (for example, marks filed through the Madrid Protocol use a Section 71 declaration instead of Section 8). USPTO fees run roughly $300–525 per class for the combined Section 8 & 9 filing (fees change, so check USPTO.gov). Missing the deadline and refiling from scratch costs far more, plus the lost priority date.
